EPO and CIPO extend PPH agreement


A patent prosecution highway (PPH) agreement between the European Patent Office (EPO) and the Canadian Intellectual Property Office (CIPO) has been extended after a successful pilot.

The extension will come into effect on 6 January 2018 and last for three more years.

According to the CIPO, by the end of September 2017, the EPO had received a total of 102 requests under the pilot, 64 based on patent cooperation treaty (PCT) work products and 38 on national work products.

Comparatively, the CIPO received 406 requests: 325 based on PCT work products and 81 based on regional work products.

PPH agreements grant patent offices the ability to request fast-track examination in the partner country after a patent application has been granted in the home country.

The EPO has signed a number of agreements in the last few years, most recently with the Brazilian Patent and Trademark Office and the Russian Federal Service for IP.
