German parliament to debate UPC ratification


The German Bundestag will soon debate two draft laws to authorise ratification of the Unified Patent Court Agreement, potentially making it the thirteenth country to ratify the agreement.

Both bills passed the first reading of parliament and are now sitting for their second and third readings, scheduled to begin on 9 March, after which a final vote will be held.

The bills state that the agreement is of “particular economic importance” to Germany.

German ratification would mark one of the final milestones of the UPC Agreement, which requires 13 countries to ratify before it takes effect. These must include the UK, Germany and France.

The UK has signed the UPC Protocol on Privileges and Immunities ahead of its ratification of the agreement, but whether the country does ratify in the fallout of its vote to leave the EU remains to be seen.
