China could establish appellate IP court


China plans to institute a national appellate intellectual property court akin to the US Court of Appeals for the Federal Circuit, according to senior China counsel at the US Patent and Trademark Office, Mark Cohen.

Chinese academic professor Wu Handong said at an IP symposium on 10 May that the Supreme People’s Court of China had recommended the adoption of a specialised appeals court.

According to Cohen’s blog post, Wu said the court would be in addition to new intermediate level IP courts being established in Chengdu, Nanjing, Suzhou and Wuhan, as well as the expansion of existing IP courts in Beijing, Shanghai and Guangzhou.

The appellate court would focus on technology-related IP issues and cover similar areas to existing IP courts.

Wu was responding to a question from former Chief Judge of the US Court of Appeals for the Federal Circuit, Randall Rader.

Chengdu officials also noted that they had received approval to conduct trial experiments in combined local administration of IP issues.
